West Bengal CM Mamta Banerjee Challenged the Election Commission And Filed Petition

According to sources Mamta Banerjee filed an petition in Calcutta High-court. She challenged the Nandi gram election result and filed the petition in the court to recount. Mamta accused the election commission that in Nandi gram election are totally biased. She also said that in poll counting center imposed power for biased election result.

As well as she has sought that Suvendhu Adhikari’s be declared void on grounds of corrupt practice. The Election Commission’s role ends with the declaration of results. That is once the Returning Officer has signed the final result sheet.

What is an election petition?

When election is finish then returning officer provides the final sheet of elections. With this sheet if a candidate not agree with the result of election poll. Then he files the petition for recount. Such a person can challenge the result through an petition submitted to the High Court of the state in which the constituency is located.

So Indian constituency provides the legal right to candidate. Such a petition has to be file within 45 days from the date of the poll results; nothing entertained by courts after that. Although the Representative of the People Act of 1951 suggests that the High Court should try to conclude the trial within six months, it usually drags on for much longer, even years.
